Federal Fair Housing Act

The federal Fair Housing Act (Title VIII of the Civil Rights Act of 1968, as amended) prohibits discrimination in the sale, rental, and financing of dwellings, and in other housing-related transactions, based on the following protected classes:

  • Race
  • Color
  • National origin
  • Religion
  • Sex (including sexual orientation and gender identity, per 2021 HUD guidance)
  • Familial status
  • Disability

Florida Fair Housing Act

The Florida Fair Housing Act (Chapter 760, Part II, Florida Statutes) mirrors federal protections and is enforced by the Florida Commission on Human Relations. It prohibits discriminatory housing practices statewide based on the same protected classes listed above.

Palm Beach County & Local Protections

Palm Beach County’s Equal Housing Ordinance and the City of West Palm Beach Human Rights Ordinance extend fair housing protections beyond federal and state law to also include:

  • Sexual orientation
  • Gender identity and expression
  • Age
  • Marital status
  • Lawful source of income
